Terms and Conditions

These terms and conditions ("Agreement") applies to companies' and other organizations' ("Business User") and any individual’s (“Consumer User”) use of petinsurancereview.co.uk ("website”) review service owned and operated by Symphony Digital Ltd (“we”, “us” and “our”).  Please read these terms carefully before using this website.

We are registered in England and Wales under company number and have our registered office at 7 Priory Court, Poulton, Cirencester, Gloucestershire GL7 5JB.  To contact us, please email hello@petinsurancereview.co.uk 

The terms of use listed below (referred to as 'terms') apply to a Business User’s or a Consumer User’s (each may be referred to as a “User” or “you” or “your”) use of the website and your use of “services”, which refers to a Consumer User’s ability to contribute reviews to the website and a Business User's ability to respond to such reviews.  By using the website and the services you accept that these terms and that you agree to comply with them.  If you do not agree to the terms, you must not use the website or the services.  We recommend that you print a copy of these terms for future reference. 

1. USERS and REGISTERED USER

Any Consumer User can leave a review of their pet insurer at anytime, without registering.  To get access to, and make full use of the quotation services, (when available) a Consumer User must register as a registered user on the website.

While registering, you must choose a password to use along with your email address when you log on to the website. The password is unique to your account and must be kept confidential and not be shared or in any other way made available to third parties. Account passwords are encrypted, which means we can't see your passwords. We can't resend forgotten passwords either. We'll only reset them.

We have the right to disable any user name or password or delete your account at any time without notice.

2. CONTRIBUTIONS FROM USERS and REGISTERED USERS

All material, information, reviews, mentions and any other form of communication (hereafter all referred to under the term “contributions”) that are received from users (registered or unregistered) via the website will be regarded as non-confidential and non-proprietary and will not entitle the user to royalties or any form of compensation. You retain all of your ownership rights in your contribution, but you are required to grant us, and where you are a Consumer User, you are required to grant to our Business Users, an irrevocable, perpetual, royalty free licence to use, edit, publish, store and copy that contribution and to distribute and make it available to third parties via the website.


All users are responsible for the content of the contributions they publish on the website. We are in no way responsible for any libellous comments or contributions that could be classed as defamation in a British court of law.

Users may not publicise contributions on the website that 

(a)is unlawful, harmful, threatening, defamatory, obscene, infringing, harassing or racially or ethnically offensive;

(b)facilitates illegal activity;

(c)depicts sexually explicit images;

(d)promotes unlawful violence;

(e)is discriminatory based on race, gender, colour, religious belief, sexual orientation, disability; 

(f) is not the user’s original work; 

(g) contains personally identifiable information; or

(h) is of a marketing nature of for marketing purposes (except where posted by Business Users); or

(i)is otherwise illegal or causes damage or injury to any person or property;

and we reserve the right to disable your access to any material that breaches the provisions of this clause.


Users are in all cases responsible for the legality of the contribution and all contributions must be correct and true (where they state facts) or genuinely held (where they state opinions). If we believe that a contribution breaches any of the above, the contribution will be deleted immediately. The offender will also be banned from writing future reviews, comments or providing any other contributions to the website. We reserve the right to delete reviews that are solicited from external websites.

You warrant that your contribution will comply with these terms, and you will be liable to us and indemnify us for any breach of that warranty.  This means that you will be responsible for any loss or damage we suffer as a result of your breach of warranty. 

We reserve the right to delete contributions at any time and with no warning or explanation. If you email hello@petinsurancereview.co.uk we will do our best to provide a reason.

3. THE WEBSITE

We are not responsible for viruses and you must not introduce them.

We do not guarantee that our website will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our website. You should use your own virus protection software.

You must not misuse our website by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our website, the server on which our website is stored or any server, computer or database connected to our website. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our website will cease immediately.

4. OUR MATERIAL

We are the owner or the licensee of all intellectual property rights in our website, and in the material published on it (except for the contributions). Those works are protected by copyright laws and treaties around the world. All such rights are reserved. Our status (and that of any identified contributors) as the authors of content on our website must always be acknowledged.  

All company names, brands and other company trademarks and the website belong to either Symphony Digital Ltd or third parties and you are not permitted to use them without our approval or the approval of the relevant third party.  

You must not use any part of the content on our website for commercial purposes without obtaining a licence to do so from us or our licensors (as appropriate). The website's content can not be copied and displayed anywhere else on the internet or otherwise.

If you print off, copy or download any part of our website in breach of these terms of use, your right to use our website will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

 5. OUR RESPONSIBILITY FOR LOSS OR DAMAGE SUFFERED BY YOU

5.1 Whether you are a Consumer User or a Business User we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

5.2 If you are a Business User: 

a) We exclude all implied conditions, warranties, representations or other terms that may apply to our website or any content on it.

b) We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our website; or
  • use of or reliance on any content displayed on our website.

In particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

5.3 If you are a Consumer User:

a) Please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

b) If defective digital content that we have supplied, damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage that you could have avoided by having in place reasonable system security requirements. 

5. PERSONAL INFORMATION

Our processing of personal data in connection with the use of the services and with PetInsuranceReview.co.uk is carried out in accordance with our Privacy Policy and appropriate data protection laws. 

6. INFORMATION ON THIS SITE - DISCLAIMER

We are not the authors of the reviews displayed on the website and we are not liable for the reviews and comments made on the website nor are we responsible for their content, accuracy or completeness.  We moderate all contributions added to the website by users but we do not alter the content except to ensure compliance with these terms.   Should the contributions contain links to third parties, we will not publish the reviews. 

The content, articles, blogs and reviews provided on our website are provided for general information only and are not intended to amount to advice on which you should rely.  We will not be responsible or liable if the guiding recommendation turns out to be incorrect.   

Although we make reasonable efforts to update the information on our website, we make no representations, warranties or guarantees, whether express or implied, that the content on our website is accurate, complete or up to date.

The information about individual Pet Insurance companies is copied from each Company’s website at the date shown on each insurer profile and Symphony Digital cannot be held responsibilities for any inaccuracies.  Users are strongly advised to validate all information by checking on the individual insurer website.  

Where our website contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.  We have no control over the contents of those sites or resources.

7. MARKETING & PROMOTIONAL ANNOUNCEMENT

You agree that we may identify you as a customer on the website.

Reviews written by users will only be displayed on PetInsuranceReview.co.uk and our social media profiles, Google and Bing and associated sites.

 

8. We may make changes to these terms AND OUR WEBSITE

We amend these terms from time to time. Every time you wish to use our website, please check these terms to ensure you understand the terms that apply at that time. 

We may update and change the website from time to time to reflect changes to pet insurance products, our users' needs and our business priorities.

9. We may suspend or withdraw our site

We do not guarantee that our website, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our website for business and operational reasons. 

Our site is only for users in the UK.

10. Rules about linking to our site

A Business User may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.  You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.  You must not establish a link to our site in any website that is not owned by you.

We reserve the right to withdraw linking permission without notice.

11. Which country's laws apply to any disputes?

If you are a user, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a Business User, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
